Trademark Search

Trademark Registration

Trademark registration in India is a legal process through which a person or business secures exclusive rights over a distinctive mark used in relation to goods or services, under the Trade Marks Act, 1999. A trademark may consist of a word, logo, symbol, design, or combination thereof, which helps distinguish one entity’s offerings from those of others.

Expedited Trademark Registration

Expedited trademark registration in India is a fast-track mechanism provided under Rule 34 of the Trade Marks Rules, 2017 framed under the Trade Marks Act, 1999, which allows applicants to obtain quicker processing of their trademark applications by paying an additional prescribed fee.

Reply to Examination Reports

A reply to an examination report in trademark law is a written response filed by the applicant to address objections raised by the Registrar under the Trade Marks Act, 1999 during the examination stage of a trademark application. These objections are usually based on absolute grounds (Section 9, such as lack of distinctiveness or descriptiveness) or relative grounds (Section 11, such as similarity with earlier marks). The reply must be filed within one month from the date of receipt of the examination report.

Trademark Oppositions

Trademark opposition is a legal proceeding under the Trade Marks Act, 1999 whereby a third party challenges the registration of a trademark after it has been accepted by the Registrar and published in the Trademark Journal. Any person, not just the owner of a prior mark can, file an opposition within four months from the date of publication, on grounds such as similarity with an existing trademark, likelihood of confusion, lack of distinctiveness, or bad faith.

Trademark Rectifications

Trademark rectification is a legal remedy under the Trade Marks Act, 1999 that allows any aggrieved person to seek correction or removal of a trademark from the register after it has been registered. It is essentially used to challenge the validity of an already registered trademark on grounds such as wrongful registration, non-use, lack of distinctiveness, or that the mark was entered in the register without sufficient cause.

Replies to Trademark Opposition/Rectification

Replies to trademark opposition or rectification proceedings under the Trade Marks Act, 1999 and Trade Marks Rules, 2017 are critical defensive pleadings filed by the applicant or registered proprietor to contest challenges raised against their mark. In opposition proceedings, the applicant must file a counter-statement (Form TM-O) within the prescribed time (generally 2 months from receipt of notice), specifically denying the allegations made by the opponent and asserting grounds such as prior use, distinctiveness, or honest adoption.

Trademark Litigations

Infringement suits under the Trade Marks Act, 1999 are filed by the registered proprietor of a trademark against a person who uses an identical or deceptively similar mark without authorization. The essence of infringement is the violation of a statutory right, so the plaintiff only needs to show that the mark is registered and that the defendant’s mark is likely to cause confusion. Actual damage or deception need not always be proved. The suit can be filed before a District/Commercial Court, and importantly, Section 134 allows filing at a place where the plaintiff resides or carries on business. Remedies include injunction, damages, account of profits, delivery up, etc.
